Rules for the S.T.Dupont X-Bag Contest at its pop-up store at Galeries Lafayette Paris Haussmann from January 28 to February 24, 2025
Article 1: Contest Organizing Company
This contest, titled "S.T. Dupont X-Bag Contest at its pop-up store at Galeries Lafayette Paris Haussmann from January 28 to February 24, 2025" (hereinafter referred to as the "Contest"), is organized by S.T. Dupont, a French public limited company with a Management Board and Supervisory Board, with share capital of 14,155,547.94 euros, whose registered office is located at 92 boulevard du Montparnasse, 75014 Paris, France, registered with the Paris Trade and Companies Register under number 572 230 829 (hereinafter referred to as the "Organizing Company").
The Contest is organized to mark the opening of the S.T. Dupont pop-up store (hereinafter referred to as the "Pop-Up") from January 28 to February 24, 2025, within the Galeries Lafayette Haussmann store located at 40 boulevard Haussmann, 75009 Paris, France, a store operating under the Galeries Lafayette brand, operated by Galeries Lafayette Management, a simplified joint-stock company, with share capital of 147,184,338 euros, whose registered office is located at 27 rue de Châteaudun, 75009 Paris, France, registered with the Paris Trade and Companies Register under number 552 116 329.
This Contest will take place during the same Pop-up opening period, from January 28 to February 24, 2025, during the store's opening hours.
The objective of the Contest is to promote the S.T. Dupont brand and its products in an interactive setting, by engaging Pop-up visitors and social media users.
Participation in the Contest is completely free, with no purchase necessary, and is limited to the terms described in these rules.
Article 2: Conditions for participation
The Contest is open to any natural person aged eighteen (18) years or older at the time of their participation, residing in metropolitan France, with Internet access and an active Instagram account.
Participants must publish their photo from their Instagram account for their participation to be taken into account.
Excluded from the Contest are employees of the Organizing Company, partners or subcontractors who contributed to the organization, promotion or realization of the Contest, as well as their immediate family members, defined as spouses, ascendants, descendants, siblings living or not living under the same roof.
To be eligible, each participant must comply with the terms of these rules and all applicable laws and regulations. Any attempt at fraud or circumvention of the stated rules, by any means whatsoever, will result in the immediate and permanent exclusion of the participant. The Organizing Company also reserves the right to request any supporting identity or eligibility documents to verify compliance with the participation conditions.
Only one entry per person will be accepted for the entire duration of the Contest. Any multiple or non-compliant entry will result in the exclusion of the participant concerned. The mere fact of participating in the Contest implies the unreserved and full acceptance of these rules by the participant.
Article 3: Terms of participation
The Contest takes place exclusively at the S.T. Dupont Pop-up at Galeries Lafayette Haussmann, located at 40 boulevard Haussmann, 75009 Paris, France, between January 28 and February 24, 2025, during store opening hours.
To participate, each candidate must go to the Pop-up location and take a photograph highlighting one of the following S.T. Dupont brand products: a handbag from the X-Bag collection. The photo must then be published on the Instagram social network from the participant's account, accompanied by the official hashtag "#STDUPONT" and by tagging the brand's official Instagram account "@stdupont". The participant can also tag "Galeries Lafayette".
Participation is strictly limited to one photo per person and per Instagram account for the entire duration of the Contest. Any attempt at multiple participations or any publication not complying with the
stated conditions will be considered invalid and may lead to the definitive exclusion of the participant.
The Organizing Company reserves the right to verify the conformity of participations at any time, notably by examining publications and by requesting proof of identity or ownership of the Instagram account used. In case of non-compliance with these terms or proven fraud, participation will be immediately cancelled.
Participation in the Contest is free and implies no obligation to purchase. All validated participations will be included in a draw in accordance with the provisions of these rules.
Article 4: Results and Award of Prize
At the end of the Contest, a drawing will be
organized by the Organizing Company among all valid entries complying with the terms set forth in these rules. The drawing will take place on February 25, 2025, at the registered office of the Organizing Company or any other location designated by the latter. This drawing will be conducted electronically using secure software.
Only one winner will be designated during this drawing. The selected participant will win an S.T. Dupont handbag from the X-Bag collection with the following references: MEDIUM X BAG BLACK, Ref 1XB283BK1, EAN 3597390300997, with an indicative value of €1,725 (one thousand seven hundred twenty-five euros).
The winner will be immediately contacted by the Organizing Company by phone. Should there be no response within seven (7) days, the Organizing Company reserves the right to award the prize to another participant designated by a new drawing.
The prize will be awarded by the Organizing Company in a VIP (Very Important Person) lounge, within the Galeries Lafayette Haussmann store located at 40 boulevard Haussmann in Paris, reserved and privatized by the Organizing Company. In the event of justified impossibility, the prize
may be sent by post to the address provided by the winner.
The Organizing Company cannot be held responsible for the loss, theft, or deterioration of the prize after it has been given to the winner.
The awarded prize may under no circumstances be exchanged for another S.T. Dupont product or for financial compensation, nor transferred or assigned to a third party. In the event of force majeure, the Organizing Company reserves the right to replace the prize with another prize of equivalent value.
Article 5: Disqualification
The Organizing Company reserves the right to permanently exclude any participant from the Contest if they do not comply with the conditions set out in these rules. This includes, but is not limited to, proven cases of fraud, attempted cheating, or circumvention of the rules, such as using false identities, publishing non-compliant content, or multiple entries from the same account.
In the event of a breach, the offending participant will be immediately disqualified without prior notice or further justification from the Organizing Company. Disqualification entails the loss of all rights related to the Contest, including the potential prize. If the prize has already been awarded, the Organizing Company reserves the right to reclaim it and redistribute it to another eligible participant, in accordance with the terms of these rules.
The Organizing Company also reserves the right to take legal action against any participant found guilty of fraud or attempted manipulation that would undermine the integrity or smooth running of the Contest.
Article 6: Exemption from liability
The Organizing Company cannot be held responsible for any technical malfunctions, connection problems, data losses, interruptions, or any other incident beyond its control that may occur during participation in the Contest. These hazards include, but are not limited to, errors due to telecommunications operators, Internet access, or problems related to the social media platforms used for participation.
In the event of cancellation, postponement, or modification of the Contest for reasons beyond its control, such as unforeseen circumstances or force majeure events, the Organizing Company cannot be held liable. However, it undertakes to inform participants as soon as possible and to ensure fair management of the situation.
Similarly, the Organizing Company disclaims all responsibility in the event of loss, theft, deterioration, or misuse of the prize once it has been handed over to the winner. It cannot be held responsible for any consequences related to the use of the prize by the winner or by a third party.
Participation in the Contest implies full and complete acceptance of the characteristics and limitations of digital networks, including risks related to data interruption or corruption, fraudulent intrusions, and security flaws. Participants acknowledge that complete security of electronic communications cannot be guaranteed.
Finally, the Organizing Company cannot be held responsible for any direct or indirect damages that may result from participation in the Contest, errors in participation, or the inability to participate for reasons beyond its control.
Article 7: Consultation and Amendment of the Regulations
These Contest Rules are made available to participants free of charge for consultation. They are accessible throughout the Contest period at the following addresses:

Participation in the Contest implies full and unreserved acceptance of these rules by participants, with no possibility of claiming against its terms.
The Organising Company reserves the right to modify, suspend, or cancel the Contest, or to adjust its access conditions and procedures, if circumstances beyond its control so require. Any modification will be brought to the attention of participants by way of an addendum, which will be accessible under the same conditions as the original rules.
Modifications to the rules will take effect upon their publication and will automatically apply to all participants, including those who have already participated in the Contest before the modification. Participants are invited to regularly consult the rules to be aware of any changes.
No indemnity or compensation may be claimed by participants following any modification, suspension, or cancellation of the Contest.
Article 8: Intellectual Property
The trademarks, logos, trade names, and all other intellectual property elements used in connection with the Contest, including those related to the S.T. Dupont brand, Galeries Lafayette, and any products presented, are the exclusive property of their respective owners. Any reproduction, representation, exploitation, transmission, modification, or use, in whole or in part, of these elements, by any means whatsoever, without the prior written authorization of the rights holders, is strictly prohibited and would constitute a violation of applicable intellectual property laws.
Participation in the Contest does not in any way grant the participant any ownership or license rights over elements protected by intellectual property rights belonging to the Organizing Company or its partners. Content created and disseminated within the framework of the Contest by the Organizing Company, including visuals, photos, videos, and communication materials, also remains its exclusive property.
Any infringement of the provisions of this article exposes the offender to civil and/or criminal proceedings, in accordance with the legal provisions in force. The Organizing Company reserves the right to claim compensation for any damage suffered due to unauthorized use of its intellectual property elements.
By participating in the Contest, participants expressly accept these provisions relating to the protection of intellectual property rights.
Article 9: Personal Data Protection
Within the framework of the Contest, the Organizing Company collects and processes participants' personal data, such as their last name, first name, email address, postal address, telephone number, and possibly their Instagram username. This information is essential for managing the Contest, particularly for verifying participants' eligibility, contacting the winner, and awarding the prize.
The Organizing Company undertakes to comply with Regulation No. 2016/679 of April 27, 2016 ("GDPR"), as well as Law No. 78-17 of January 6, 1978, known as the "Data Protection Act," as amended, and any law, directive, or regulation that may supplement or replace it. The personal data collected will be used exclusively within the framework of the Contest and retained only for the period necessary for its management, until the prize is awarded, extended by three (3) years if the participant has consented to receive commercial offers or information on S.T. Dupont products.
Participants have rights regarding their personal data, including the right of access, rectification, erasure, restriction, objection, and portability, which they can exercise at any time by contacting the Organizing Company by email at the following address: rgpd@st-dupont.com.
Furthermore, they can withdraw their consent to receive commercial communications by using the unsubscribe link included in the Organizing Company's emails, without affecting their participation in the Contest.
The Organizing Company takes all necessary technical and organizational measures to ensure the security and confidentiality of the personal data collected. However, it cannot be held responsible for incidents that may occur during data transfer over public networks, such as social media, which are beyond its control.
By participating in the Contest, participants agree that their data may be used in accordance with the provisions set out in this article. In the event of a dispute concerning the processing of their personal data, participants have the right to lodge a complaint with the Commission Nationale de l’Informatique et des Libertés (CNIL) in France.
Article 10: Governing law and competent jurisdiction
These rules are governed exclusively by French law. Any question regarding the validity, interpretation or execution of these rules will be examined in accordance with this legislation.
In the event of disagreement or dispute concerning the Contest, participants and the Organizing Company will endeavor to find an amicable solution within two (2) months from the date the dispute arises. Claims must be submitted in writing and addressed to the Organizing Company by post at the following address: S.T. Dupont, 92 boulevard du Montparnasse, 75014 Paris, France, or by email at the following address: jeuconcours@stdupont.com.
Should an amicable resolution not be reached within the specified period, any dispute or litigation relating to the interpretation or execution of these rules will be submitted to the exclusive jurisdiction of the French courts, and more specifically the courts of Paris.
Any request or dispute concerning the Contest must be submitted in writing within two (2) months after the Contest end date. After this period, any request or claim will be considered inadmissible.
Participation in the Contest implies full and complete acceptance of the jurisdiction of the French courts to settle any dispute related to these rules.
Article 11: Acceptance of the Regulations
Participation in the Contest implies the participants' unreserved and full acceptance of these rules. Any breach of any of the provisions of the rules will result in the immediate cancellation of the participation concerned and, if applicable, the return of the prize awarded.
These rules can be consulted free of charge throughout the duration of the Contest.
Any modification or adaptation of these rules will be subject to an addendum, which will be communicated to participants by means deemed appropriate by the Organizing Company, such as by email, and which
will be accessible under the same conditions as these rules.
In the event of a discrepancy between the provisions of these rules
and the statements or interpretations arising from communication materials or statements by third parties, only these rules shall prevail.
The possible nullity of one of the clauses of these rules will in no way affect the validity of the other clauses.
